These Terms & Conditions ("Terms") govern your access to and use of Better Sports Analytics, including our website, mobile application, backend services, and related support channels (collectively, the "Platform"). By creating an account, accepting an invite, accessing the Platform, or using the Platform on behalf of an academy, you agree to these Terms.

If you create or manage an account for a child or minor player, you confirm that you are the parent, legal guardian, or duly authorized academy representative with the authority to provide the required information and accept these Terms and the Privacy Policy on the player's behalf.

1. Platform Purpose

Better provides academy management tools for player registration, phone-based account access, attendance, schedules, feedback, skill metrics, plans, payments, notifications, reports, announcements, equipment workflows, and related academy operations. The Platform is an operational software tool. It does not replace professional coaching judgment, medical advice, legal advice, accounting advice, or academy decision-making.

2. Account Registration and Access

  • Accounts may be created through academy invitations or other approved registration flows.
  • You must provide accurate and current information, including name, date of birth, gender, phone number, role, academy or center assignment, and profile photo where required.
  • The Platform uses phone-based OTP verification and session tokens. You are responsible for maintaining control of your phone, device, OTP messages, and account access.
  • You must not share login credentials, OTPs, invite tokens, or account access with unauthorized persons.
  • Better or the academy may restrict, suspend, deactivate, or remove access where required for security, misuse, academy administration, non-payment, or legal compliance.

3. User Responsibilities

  • Use the Platform only for lawful academy, coaching, player, guardian, staff, and administrative purposes.
  • Do not upload or submit unlawful, misleading, abusive, discriminatory, infringing, harmful, or unauthorized content.
  • Do not attempt to bypass role permissions, access another user's data without authorization, disrupt services, probe systems, introduce malware, scrape data, reverse engineer the Platform, or misuse APIs.
  • Review attendance, payments, player records, feedback, and reports for accuracy and promptly notify your academy or Better support about suspected errors.
  • Report suspected account compromise, unauthorized access, or security issues to support@bettersportsanalytics.com.

4. Academy Responsibilities

  • Academies are responsible for configuring centers, batches, plans, schedules, payment expectations, staff access, and user roles correctly.
  • Academies must ensure that coaches, admins, owners, and staff are authorized to access the Platform and the data available to their roles.
  • Academies must obtain and maintain verifiable parent/guardian consent and any required notices, permissions, and authorizations before creating minor player accounts or uploading minor player data, profile photos, attendance images, payment records, or communications.
  • Academies are responsible for the accuracy of information entered by their authorized users, including attendance, feedback, skill metrics, plan assignments, announcements, payment approvals, and equipment records.
  • Academies must use exported reports, payment statuses, and operational data responsibly and in accordance with applicable law.

5. Player Photos, Attendance, and Recognition

  • The Platform may require clear profile photos for player accounts and may use uploaded profile photos or attendance images to support player identification and automatic attendance workflows.
  • For minor players, photos and attendance images may be uploaded or processed only when the parent, legal guardian, or academy has provided the required consent and authority.
  • Photo and face-recognition processing is limited to academy operations such as identity verification, attendance marking, safety, and record accuracy. It is not used for advertising or unrelated profiling.
  • Image recognition, face detection, attendance confidence scores, and similar outputs are operational aids and may not be perfect. Academies and authorized staff must review and correct attendance records where needed.
  • You must not upload images unless you have the authority and consent required to do so.
  • Better may reject, remove, or request replacement of photos that are unclear, unsafe, inappropriate, or unsuitable for attendance workflows.

6. Payments and Records

  • The Platform may display registration fees, dues, payment history, pending amounts, payment screenshots, payment approval workflows, and plan-related records based on academy configuration.
  • Unless a separate written agreement says otherwise, academies remain responsible for collecting, verifying, approving, reconciling, refunding, and accounting for payments from their players or guardians.
  • Payment screenshots, UPI references, manual approval records, and status changes are provided to support academy operations and may require human review.
  • Better may charge academies subscription, implementation, usage, support, or other fees under a separate order form, invoice, or service agreement. Taxes, duties, and government charges are the responsibility of the paying party unless otherwise agreed.

7. Content, Feedback, and Communications

  • Academies, coaches, admins, players, guardians, and staff remain responsible for announcements, feedback, comments, photos, screenshots, profile data, and other content they submit.
  • You grant Better a limited right to host, store, process, transmit, display, and use submitted content only as needed to provide, secure, support, improve, and maintain the Platform.
  • The Platform may send in-app notifications, push notifications, app update notices, reminders, and operational messages. Some communications are necessary for account, security, or academy operations.

8. Intellectual Property

  • Better owns the Platform, including software, design, workflows, reports, interfaces, logos, trademarks, documentation, and related intellectual property.
  • Subject to these Terms, Better grants authorized users a limited, revocable, non-exclusive, non-transferable right to use the Platform for permitted academy operations.
  • You may not copy, modify, resell, sublicense, reverse engineer, or create derivative works from the Platform except where expressly allowed by law or written agreement.
  • Feedback or suggestions you provide may be used by Better without restriction or compensation.

9. Service Availability and Changes

  • Better may improve, modify, suspend, or discontinue features, integrations, reports, permissions, or workflows.
  • We aim to provide reliable service, but the Platform may be affected by maintenance, connectivity, device issues, third-party services, cloud providers, app store availability, or events outside our control.
  • Better may release updates that are required for security, compatibility, legal compliance, or continued Platform use.

10. Privacy and Data Protection

Our collection and use of personal information is described in the Privacy Policy. By using the Platform, you acknowledge that Better processes information such as account details, academy assignments, player records, photos, attendance, payment records, device identifiers, notification tokens, support communications, and technical logs as described there.

11. Disclaimers

  • The Platform is provided on an "as is" and "as available" basis to the maximum extent permitted by law.
  • Better does not warrant that the Platform will be uninterrupted, error-free, perfectly accurate, or free from harmful components.
  • Reports, recognition results, attendance outputs, leaderboard scores, payment statuses, and recommendations are operational tools and should be reviewed by authorized academy users.

12. Limitation of Liability

  • To the maximum extent permitted by law, Better Sports Analytics will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, data, use, or business interruption.
  • To the maximum extent permitted by law, Better's total liability for claims arising out of or relating to the Platform or these Terms will not exceed the fees paid to Better for the Platform in the twelve (12) months before the event giving rise to the claim.
  • Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Indemnity

You and any academy using the Platform agree to defend, indemnify, and hold Better Sports Analytics harmless from claims, losses, liabilities, damages, costs, and expenses arising from misuse of the Platform, unauthorized data or image uploads, violation of these Terms, violation of law, or content submitted by your authorized users.

14. Updates to These Terms

We may update these Terms from time to time. If an update materially changes your rights or obligations, we may notify users or require acceptance of the updated Terms before continued use of the Platform. The "Last updated" date above identifies the latest website version.

15. Governing Law and Disputes

  • These Terms are governed by the laws of India.
  • Parties should first try to resolve disputes through good-faith discussions. If unresolved, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996.
  • The seat and venue of arbitration will be Bengaluru, Karnataka, India, and the language will be English, unless the parties agree otherwise in writing.
  • If any provision is found unenforceable, the remaining provisions will continue in effect.
